Uninsured Motorist Claim Results in Multi-Million-Dollar Verdict

Back in the spring of 2022, our client was driving down Moss Street in Lafayette Parish when another driver blew through a stop sign, crashing into his car.

Our client, a military veteran and dedicated family man, began to experience persistent neck and back pain just two weeks after the crash. He started physical therapy, hopeful it would provide relief. When it didn’t, he underwent a cervical epidural injection. Still, the pain didn’t let up. Eventually, doctors performed a two-level cervical fusion, which was an invasive procedure aimed at easing his suffering. His physician warned that another surgery might be necessary down the road.

The client’s own uninsured motorist (UM) insurance company offered little more than the minimum coverage from the at-fault driver. They also dismissed his pain, pointing to the minimal vehicle damage. Before the trial began, they made no effort to settle, offering zero dollars.

The jury listened and returned a powerful verdict: $2 million awarded for the veteran’s pain and suffering, mental anguish, loss of enjoyment of life, permanent disability, and past medical expenses. An additional $400,000 was awarded for future medical care. The jury also found that the insurer acted improperly by failing to settle the claim within 30 days, triggering penalties, attorney’s fees, and other costs, adding approximately $1MM to the judgment.
